Refund & Liability Policy

This Refund & Liability Policy sets out when fees may be refunded and disclaims Kiwi Funded’s liability for certain matters. It forms part of, and must be read together with, the Terms of Service (including the Limitation of Liability provisions). Kiwi Funded provides simulated services only; fees are consideration for access to those services and are not deposits or investments.

1. Services rendered on access

Kiwi Funded considers its services rendered in full upon granting you access to an Account, regardless of whether you use, or continue to use, that access. The purchase of an evaluation buys access to a simulated evaluation environment; it does not buy any guaranteed outcome, Funded Account, or Reward.

2. Strict no-refund on traded accounts

We operate a strict no-refund policy for any Account on which trading activity has occurred, regardless of the number of trades placed, the results obtained, or any technical issue experienced. By placing any trade — simulated or otherwise — you expressly waive any right to a refund of the associated fee.

3. Untraded accounts (discretionary)

We may, in our sole discretion, consider a refund request for an Account that has never been traded and where the request is made within a reasonable period after purchase. Eligibility and approval rest exclusively with Kiwi Funded, and consideration of a request does not oblige us to grant it.

4. No refunds after violations

Refund eligibility does not apply where an Account has been breached, disqualified, suspended, closed, or otherwise subject to a violation of the Terms of Service or any incorporated agreement. In such cases all fees are retained and any pending Reward is forfeited.

5. Disclaimer for isolated technical issues

To the fullest extent permitted by law, Kiwi Funded is not responsible or liable, whether in contract, tort, or otherwise, for any loss, damage, cost, or expense arising from or in connection with any isolated technical issue experienced by an individual Trader. Such issues include, without limitation: individual disruptions, malfunctions, or errors in data feeds or trading platforms; malfunctions or errors in trade-copier or third-party systems (including automated trading systems and custom indicators); instability or disconnections caused by the Trader’s own connectivity, hardware, or software; and slippage (positive or negative) occurring around scheduled or unscheduled news, periods of high volatility, or within ordinary market fluctuations.

We have no obligation to issue refunds, adjustments, credits, or any other compensation for such matters. You acknowledge that you are solely responsible for the maintenance, stability, and adequacy of your own technical environment.

6. Limitation of liability

This Policy is read together with the Limitation of Liability in the Terms of Service. To the fullest extent permitted by law, and because the Services are simulated and involve no real trading capital, Kiwi Funded’s total aggregate liability to you will not exceed the greater of one hundred dollars ($100) or the amount you paid to Kiwi Funded in the one (1) month immediately preceding the event giving rise to the claim.

7. Chargebacks and fraudulent claims

By purchasing any product or service, you agree not to initiate a chargeback or payment dispute with your bank, card provider, or payment processor for any transaction properly authorised and processed by us. Any chargeback, dispute, or reversal determined by us, the payment processor, or an investigating body to be fraudulent, unfounded, or in violation of this Policy is a material breach of your agreement with us.

A Trader who initiates a fraudulent or improper chargeback will be permanently banned from all current and future access to the Services, and all their Accounts and pending Rewards will be forfeited. We reserve the right to recover the disputed funds together with any fees, costs, and damages (including reasonable legal fees) through legal action, arbitration, or collection. All determinations by Kiwi Funded regarding chargebacks and fraudulent claims are final and binding.

8. How to request a refund

Email support@kiwifunded.com from your registered email address with your order ID and the reason for your request. We aim to respond within a reasonable time. Submitting a request does not guarantee approval and does not pause any applicable deadlines.

This document forms part of the Kiwi Funded legal framework and should be read together with the Terms of Service, Privacy Policy, Risk Disclosure, Refund & Liability Policy, Trader Agreement and Challenge Agreement.
